Between: Outgrown, LLC ("Outgrown," "we," "us"), a New York limited liability company, Kings County
And: you, the person requesting the bag ("you")

Accepted online when you request a bag. The bag-request form can't be sent without your acceptance. These terms sit alongside our Terms & Conditions and our Privacy Policy; where they differ on consignment, this agreement wins.


1 · What this covers

You send us clothing your children have outgrown. We sort it, photograph it, price it, list it on outgrownny.com and sell it. You get paid when it sells. This agreement covers everything in the bags you send us.

2 · The bag

The bag is $20. It's a deposit, not a fee: it comes back to you in full as store credit the first time one of your pieces sells.

If nothing in your bag makes the drop, we refund the $20. The bag comes back with us at pickup either way. No conversation needed.

The tote stays part of the service — it travels with your bag and comes back with us at pickup, ready for the next family. You have 45 days. Text us any time to push your pickup and we'll always say yes — there's no limit, and asking always keeps the window open. If the bag isn't back with us within 45 days and we haven't heard from you, we charge the tote's $80 replacement cost to the card you used for the deposit. With the $20 deposit, that's what the bag costs us to make — we don't earn a dollar on it. We'll always email you before any charge goes through.

3 · What we take

Children's clothing, ages 0 to 6, in like-new or gently worn condition. We run a curated shop, not a scroll: premium labels, and pieces that earn their place whatever the label says. We don't do volume.

We do not take footwear, strollers, car seats or other gear, toys, décor, or jewelry.

We decide what makes the drop. We'll tell you what we took and what we didn't, piece by piece.

4 · Your clothes stay yours until they sell

You own everything in the bag until the moment a piece sells. We hold it as your agent, not as our own property.

That means it is not an asset of Outgrown, it does not appear on our balance sheet, and it is not available to our creditors. When a piece sells, title passes to the buyer; when a piece is donated under §8, title passes to the charity. You authorize us to make each of those transfers on your behalf.

Once we’ve collected a piece, please don’t list or sell that same piece anywhere else — another shop, a resale app, a stoop sale — until we’ve told you it didn’t make the drop, or you’ve claimed it back. Everything here is one of one, so a buyer who’s been told a piece is theirs shouldn’t lose it to a second sale. If it does happen, all we’ll ask is that you tell us quickly so we can pull the listing and look after the buyer. We won’t charge you for it.

5 · What we do, at our cost

Collect, sort, launder or steam where needed, photograph, measure, describe, price, list, store, and ship to the buyer. You pay nothing for any of it beyond the deposit and the replacement cost set out in §2.

6 · Pricing

We set the price. We price against real sold comparables so pieces move rather than sit, and we may reduce a price after 30 and after 60 days to keep things moving, and your share is worked out on that reduced price. We don't guarantee a minimum price.

We can’t quote a price before we’ve seen a piece. Pricing needs the actual garment in hand — its condition, the season, and what comparable pieces have really sold for — so any number given beforehand is a guess, not an offer. Once we’ve sorted your bag, you’ll see each piece and its proposed price before anything lists.

7 · What you get paid

Calculated on what the piece sells for — if we mark it down or run a promotion, your share is worked out on that price. We decide which tier a label falls in, using our current list.

The rates, the tier, the payout basis and the 90-day window that apply to a piece are the ones in force on the day we accept it. If we change them later, the change applies only to bags accepted after that.

You choose credit or cash once, when you sign up, and you can change it any time. You don't get asked every time something sells.

Store credit never expires, and it's yours even if you stop consigning with us. Cash payouts go out weekly, within 7 days of the sale, by the method you choose when you sign up. We'll ask for the details we need to pay you when you first choose cash.

8 · What we don't take, and what doesn't sell

Didn't make the drop: once we've sorted your bag we email you what made the drop and what didn't. That email is the moment to claim anything back — reply and we'll bring it back to you on our next run through your neighborhood. Anything you don't claim then goes to Good+ Foundation, Room to Grow or Little Essentials, all here in New York.

Listed but unsold after 90 days: donated to the same partners on your behalf. You're giving us that authorization now, at intake, so nothing sits in limbo. The curation email is the one moment pieces come back — once a piece is listed it stays with us until it sells or is donated.

Notices under this section go to the email on your account and count as given when sent. We never use text messages for consignment notices, so opting out of texts never affects your bag.

Donation receipts. If you'd like one, our donation email will include the link to the charity's own receipt form, and you request it from them directly. The receipt comes from Room to Grow, Good+ or Little Essentials, not from Outgrown. Whether you can deduct anything is a question for your own tax adviser; we make no representation either way.

9 · While your clothes are with us

We store your pieces in a secure, climate-reasonable space and handle them with the same care we give our own goods.

We're a consignment shop, not an insurer. We do our best by every piece, but we can't take responsibility for loss or damage while your pieces are with us, and we don't insure pieces individually. What we do promise: nothing of yours ends up in landfill — a piece that can't be sold moves on to another kid through our donation partners.

We are not responsible for ordinary handling wear from photography and display, for pre-existing wear disclosed in the listing, or for loss by the carrier once a piece has shipped to a buyer. If something ever does go wrong with one of your pieces, tell us — we'll always talk it through with you.

10 · Your family's privacy

We never publish your child's name, age or photograph. Not in a listing, not in marketing, not on social.

We may say which neighborhood a piece came from — only if you opt in — and never anything more specific than that. No street, no building, no school.

What we hold: your name, email, phone, pickup address, your bag and payout history, and, if you choose cash, the details we need to pay you. We use it to run your bag, deliver your orders and pay you. We never sell it. Ask us any time to see it or delete it.

11 · Founding families

If you're one of our founding families, you get 40% off everything you buy from Outgrown, for as long as we're here. That doesn't expire and it isn't conditional on sending more bags.

Pieces given during the founding pilot aren't paid out, whichever drop they're sold in; your 40% off for life takes the place of payment. Anything you send in a new bag is consigned on the terms above and paid from the rate card, like any other consignor.

12 · Condition and honesty, both ways

We photograph honestly and note wear in the listing. In return: please send things that are clean, undamaged, and genuinely wearable. Anything with rips, staining, heavy pilling or a smell won't make the drop, and sending it costs us both time.

By sending a bag you're also confirming that you own what's in it (or have the owner's OK to sell it), that it's genuine, that it hasn't been recalled or flagged for a safety issue as far as you know, and that you're selling as a parent, not as a trade reseller. If we learn of a recall or safety concern we may pull a piece at any time, before or after sale.

13 · Ending this

Either of us can stop at any time. Pieces already listed finish their 90-day window. Anything already sold still gets paid out.

14 · If Outgrown winds up

Your unsold pieces remain your property. We'll email you and you choose: collect them, or have them donated to one of our partners. They are not company assets and are not available to our creditors.

Money owed to you for pieces already sold ranks as a consignor obligation — ahead of anything owed to Outgrown's own members.

15 · The basics

New York law. Kings County courts. This is the whole agreement between us on consigning and replaces anything discussed beforehand. Changes have to be in writing.
